End of life: Catholic institutions facing the institutional dilemma

After the individual conscience clause, the institutional freedom of denominational clinics and EHPADs becomes the new front line.

The fact

Vatican News France publishes on July 23, 2026, an article on the dilemma of Catholic institutions facing end-of-life issues, following the final vote on July 15 and the appeals filed with the Constitutional Council. We had already covered the refusal of the conscience clause for pharmacists. The institutional question is now public: can hospitals, clinics, and medical-social institutions run by congregations collectively refuse to administer the lethal substance on their premises without incurring sanctions, loss of accreditation, or administrative pressure?

Our reading

The law of July 15, 2026, does not provide for an explicit exception for private confessional institutions: this is one of the ten grievances filed with the Constitutional Council between July 16 and 20, 2026. However, the Catholic doctrine is unanimous. The Catechism of the Catholic Church, in its n° 2277, considers euthanasia to be morally unacceptable. Evangelium Vitae reminds us that Catholics have a duty to refuse in conscience any cooperation with an intrinsically evil act. Institutional freedom extends personal freedom: the Second Vatican Council, in the declaration Dignitatis humanae (December 7, 1965), recognizes the freedom of religious communities to conduct their lives and works according to the prescriptions of their faith. To prohibit a Catholic institution from refusing within its premises an act that doctrine considers intrinsically evil is to deny this conciliar freedom.
